Professor Max Muller admits that we share with the lower animals what he calls an emotional language, and continues that we may call their interjections and imitations language if we like, as we speak of the language of the eyes or the eloquence of mute nature, but he warns us against mistaking metaphor for fact. It is indeed mere metaphor to talk of the eloquence of mute nature, or the language of winds and waves. There is no intercommunion of mind with mind by means of a covenanted symbol; but it is only an apparent, not a real, metaphor to say that two pairs of eyes have spoken when they have signalled to one another something which they both understand. A schoolboy at home for the holidays wants another plate of pudding, and does not like to apply officially for more. He catches the servant's eye and looks at the pudding; the servant understands, takes his plate without a word, and gets him some. Is it metaphor to say that the boy asked the servant to do this, or is it not rather pedantry to insist on the letter of a bond and deny its spirit, by denying that language passed, on the ground that the symbols covenanted upon and assented to by both were uttered and received by eyes and not by mouth and ears? When the lady drank to the gentleman only with her eyes, and he pledged with his, was there no conversation because there was neither noun nor verb? Eyes are verbs, and glasses of wine are good nouns enough as between those who understand one another. Whether the ideas underlying them are expressed and conveyed by eyeage or by tonguage is a detail that matters nothing.

Prominent among the Anglo-Saxon amusements of Christmastide, Strutt mentions their propensity for gaming with dice, as derived from their ancestors, for Tacitus assures us that the ancient Germans would not only hazard all their wealth, but even stake their liberty, upon the turn of the dice: "and he who loses submits to servitude, though younger and stronger than his antagonist, and patiently permits himself to be bound and sold in the market; and this madness they dignify by the name of honour." Chess and backgammon were also favourite games with the Anglo-Saxons, and a large portion of the night was appropriated to the pursuit of these sedentary amusements, especially at the Christmas season of the year, when the early darkness stopped out-door games.

In fact, violence mingled itself continually, in those times, with almost all public proceedings, whenever any special combination of circumstances occurred to awaken unusual excitement. At one time, when Caesar was in office, a very dangerous conspiracy was brought to light, which was headed by the notorious Catiline. It was directed chiefly against the Senate and the higher departments of the government; it contemplated, in fact, their utter destruction, and the establishment of an entirely new government on the ruins of the existing constitution. Caesar was himself accused of a participation in this plot. When it was discovered, Catiline himself fled; some of the other conspirators were, however, arrested, and there was a long and very excited debate in the Senate on the question of their punishment. Some were for death. Caesar, however, very earnestly opposed this plan, recommending, instead, the confiscation of the estates of the conspirators, and their imprisonment in some of the distant cities of Italy. The dispute grew very warm, Caesar urging his point with great perseverance and determination, and with a degree of violence which threatened seriously to obstruct the proceedings, when a body of armed men, a sort of guard of honor stationed there, gathered around him, and threatened him with their swords. Quite a scene of disorder and terror ensued. Some of the senators arose hastily and fled from the vicinity of Caesar's seat to avoid the danger. Others, more courageous, or more devoted in their attachment to him, gathered around him to protect him, as far as they could, by interposing their bodies between his person and the weapons of his assailants. Caesar soon left the Senate, and for a long time would return to it no more.
